Defamation / First Amendment Speech Defense

Some of the most difficult, complicated cases, and most poorly understood cases in America are defamation/slander/libel cases. The First Amendment affords very strong protections to individuals and businesses to speak their mind without the risk of being sued, leaving only a narrow avenue for defamation cases where someone has made a false statement of fact detrimental to someone else. Oregon law takes this a step further, introducing the “special motion to strike” or “anti-SLAPP” (Strategic Litigation Against Public Participation) motions, which require plaintiffs in first amendment speech cases to overcome unique bars to litigation not required in other cases. Andrew Paris is experienced in addressing defamation cases and getting non-meritorious defamation cases dismissed before they spiral out of control.
